1. Scope of Services

Ecosphere Waste Solutions shall provide collection, transportation, processing, and/or disposal of solid waste as agreed, strictly in accordance with the Solid Waste Management (SWM) Rules, 2016, and applicable GBA / BSWML by-laws.

2. Waste Segregation Responsibility

The waste generator shall ensure proper segregation of waste at source (wet, dry, and sanitary/reject waste) before handing over the waste to Ecosphere Waste Solutions. Non-segregated waste may attract additional charges or refusal of service.

3. Authorized Operations

All waste collected shall be transported and processed only at authorized facilities approved by GBA / BSWML / KSPCB, as applicable.

4. Service Charges and Payment Terms

Service fees shall be as mutually agreed and mentioned in the service agreement or work order. Payments shall be made within the stipulated time period. Any delay may attract penalties or suspension of services.

5. Compliance and Documentation

Ecosphere Waste Solutions shall provide valid authorization letters, service agreements, and compliance-related documents as required for regulatory or inspection purposes.

6. Inspection and Verification

Services provided are subject to inspection and verification by GBA, BSWML, Karnataka State Pollution Control Board (KSPCB), or any other competent authority.

7. Exemption of SWM Cess / User Fee

Where applicable, the waste generator may be eligible for exemption from SWM Cess / User Fee upon submission of valid proof of engagement with Ecosphere Waste Solutions and compliance with prevailing SWM by-laws.

8. Liability Limitation

Ecosphere Waste Solutions shall not be held responsible for penalties, damages, or legal consequences arising due to improper segregation, hazardous waste mixing, or incorrect information provided by the waste generator.

9. Service Modification or Termination

Either party may modify or terminate the service with prior written notice as per the terms mentioned in the agreement, subject to clearance of all outstanding dues.

10. Force Majeure

Services may be temporarily suspended due to unforeseen circumstances such as natural disasters, government restrictions, strikes, or events beyond reasonable control.

11. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of India, and jurisdiction shall lie with the competent courts in Bengaluru.
